Federal Railroad Administration Drug & Alcohol Testing - DOT Consortium


FRA-regulated employers must follow drug and alcohol testing guidelines from DOT rule 49 CFR Part 40 and FRA rule CFR Part 219. Drug Testing FRA - Maintinance of Way

FRA already applied to covered employees, but more recently, CFR Part 219 was expanded to cover maintenance-of-way (MOW) employees as well. Any person involved in the inspection, repair, or construction of roads, tracks, or bridges falls within the scope of the MOW worker.

FRA Drug & Alcohol Testing Compliance

Employees and applicants required to be tested under the FRA regulations should be aware of what to expect and be prepared to comply with the requirements. Recently, the FRA published a helpful document entitled: What You Need to Know About Federal Drug and Alcohol Testing.

Rail companies must give employees clear, unequivocal written notice of the types of federal tests they will conduct (e.g., random, reasonable suspicion, reasonable cause, follow-up, return-to-work, etc.). FRA tests will include the following:


  1. Breath alcohol tests to detect the unauthorized consumption of alcohol
  2. Urine screens to detect the presence of marijuana, cocaine, opioids (and expanded opiates), phencyclidine, and amphetamines (See 49 CFR § 40.85 and 49 CFR § 40.87)
  3. Breath, urine, and tissue (fatality) testing after qualifying FRA post-accident events.
