Federal Motor Carrier Safety Administration Drug & Alcohol Testing - DOT Consortium


As part of the United States Department of Transportation, the Federal Motor Carrier Safety Administration (FMCSA) regulates the trucking and bus industries. The FMCSA's part 382 of the code outlines the requirements for controlling and testing controlled substances and alcohol. As described in CFR Part 382, the part creates programs to prevent accidents and injuries associated with drivers of commercial motor vehicles (CMVs) who misuse alcohol or use controlled substances.

FMCSA Regulations, Part 382: Who Is Covered?

  • A transportation service that transports 16 or more passenger
  • Transport of hazardous materials that require placarding
  • A Gross Vehicle Weight Rating (GVWR) or Gross Combination Weight Rating (GCWR) of 26,001 pounds or more

FMCSA Required Training

According to 49 CFR 382.603, supervisors of commercial motor vehicle drivers who operate motor vehicles requiring commercial driver licenses need to undergo 120 minutes of training on signs and symptoms of alcohol abuse and controlled substance abuse (total 120 minutes). During this training, supervisors will learn how to identify circumstances that may potentially give rise to a reasonable suspicion that an employee is using or under the influence of alcohol or drugs to support the referral for testing.

DOT Supervisor Training is required for companies with more than one employee who operates vehicles that require a CDL on public roads. This requirement does not apply to owner-operators. However, owner-operators must still register with a consortium for DOT drug and alcohol testing.

The FMCSA DOT regulations on drug and alcohol use require FMCSA regulated employers to provide their drivers with educational materials. The FMCSA 382.61 contains the required content for drivers.
